These Terms and Conditions ("Terms") govern your access to and use of the Raw Metals website and online store (the "Site") and any purchases made through it. By accessing the Site, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

Raw Metals is operated by Raw Metals LLC, a company registered in the United States ("Raw Metals", "we", "us", or "our"). Our Site is hosted on Shopify Inc., and certain terms from Shopify's Acceptable Use Policy also apply to your use of the Site.

 

1. ELIGIBILITY

You must be at least 18 years of age (or the age of majority in your jurisdiction) to use this Site and purchase products. By using the Site you represent and warrant that you meet this requirement. Raw Metals reserves the right to refuse service to anyone for any reason at any time.

2. ACCOUNT REGISTRATION

You may browse the Site without registering. To access certain features — including order history and saved preferences — you may create an account. You agree to:

• Provide accurate, current, and complete information during registration

• Maintain and promptly update your account information

• Keep your password confidential and not share it with any third party

• Notify us immediately at support@raw-metals.com if you suspect unauthorized use of your account

You are responsible for all activity that occurs under your account. Raw Metals will not be liable for any loss or damage arising from your failure to comply with these obligations.

3. PRODUCTS & DESCRIPTIONS

Raw Metals offers clothing, apparel, and accessories through the Site. We make every effort to display our products accurately, including colors, sizing, and materials. However:

• Product images are for illustrative purposes only. Colors may appear differently depending on your monitor settings, screen calibration, and lighting conditions.

• Sizing charts are provided as a guide only. Fit may vary between styles and fabrications. We encourage you to review the size guide on each product page before purchasing.

• We reserve the right to limit quantities, discontinue products, or update product details at any time without notice.

We reserve the right to correct any errors, inaccuracies, or omissions in product descriptions or pricing at any time, including after you have submitted an order.

4. PRICING & PAYMENT

Pricing

All prices are listed in US Dollars (USD) unless otherwise stated. Prices are subject to change without notice. The price charged for an order will be the price displayed at the time you place the order.

Taxes & Duties

Sales tax will be applied to orders where required by applicable law. For international orders, you are solely responsible for any import duties, customs fees, tariffs, and taxes imposed by your country. Raw Metals is not responsible for these charges and cannot predict their amount. Failure to pay applicable duties may result in your shipment being returned or destroyed.

Payment Methods

We accept major credit and debit cards, and other payment methods displayed at checkout. All transactions are processed securely through Shopify Payments or authorized third-party processors. By submitting your payment information, you represent that you are authorized to use the payment method provided.

Failed or Fraudulent Payments

Raw Metals reserves the right to cancel any order where payment is declined, suspected to be fraudulent, or otherwise flagged as unauthorized. We may verify your identity before processing high-value orders.

5. ORDERS & ORDER ACCEPTANCE

Placing an item in your cart does not constitute a contract or guarantee of availability. An order is not confirmed until you receive an order confirmation email from Raw Metals.

We reserve the right to refuse or cancel any order for reasons including but not limited to:

• Product unavailability or stock errors

• Errors in product or pricing information

• Suspected fraud or unauthorized activity

• Shipping restrictions to your location

If we cancel your order after payment has been processed, we will issue a full refund to your original payment method within 5–10 business days.

6. SHIPPING & DELIVERY

Domestic Orders (United States)

We ship to all 50 US states. Estimated delivery times are provided at checkout and are not guaranteed. Raw Metals is not responsible for delays caused by carriers, weather events, or other circumstances beyond our control.

International Orders

Raw Metals ships internationally to select countries. By placing an international order, you acknowledge and agree that:

• You are the importer of record and are responsible for complying with all laws and regulations of the destination country

• Import duties, customs fees, and local taxes are your sole responsibility and are not included in the purchase price or shipping cost

• Delivery timelines for international shipments may vary significantly and are subject to customs clearance delays

• Raw Metals is not liable if a shipment is seized, delayed, or returned by customs authorities

Risk of Loss

Title and risk of loss for all products purchased from Raw Metals pass to you upon delivery to the carrier. Raw Metals is not responsible for lost or stolen packages after carrier confirmation of delivery.

Shipping Address

You are responsible for providing a complete and accurate shipping address. Raw Metals is not responsible for orders lost or delayed due to incorrect address information provided by you.

7. RETURNS, REFUNDS & EXCHANGES

Return Window

We accept returns on eligible items within 7 days of the delivery date. To initiate a return, contact us at support@raw-metals.com with your order number and reason for return.

Eligible Items

To be eligible for a return, items must be:

• Unworn, unwashed, and in original condition with all tags attached

• Free from odors, stains, pet hair, or signs of wear

• Accompanied by proof of purchase

• Returned in original or equivalent protective packaging

Non-Returnable Items

The following are not eligible for return:

• Intimates, underwear, swimwear, and hosiery (for hygiene reasons)

• Final sale or clearance items marked as non-returnable at time of purchase

• Items that have been worn, washed, altered, or damaged after delivery

• Gift cards

Exchanges

We offer exchanges for different sizes or colors on eligible items, subject to availability. To request an exchange, contact us at support@raw-metals.com. If your preferred size or color is unavailable, we will issue a store credit or refund.

Refunds

Once we receive and inspect your return, we will notify you of the approval or rejection of your refund. Approved refunds will be processed to your original payment method within 5–10 business days. Original shipping costs are non-refundable unless the return is due to our error (e.g., wrong item sent, manufacturing defect).

International Returns

International customers are responsible for all return shipping costs and any applicable customs fees. We recommend using a trackable shipping service. Raw Metals is not responsible for items lost in transit during a return.

8. INTELLECTUAL PROPERTY

All content on the Site — including text, graphics, logos, product photographs, video, audio, and software — is the property of Raw Metals or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes. You may not:

• Reproduce, distribute, modify, or create derivative works of any Site content without our prior written consent

• Use our name, logo, or trademarks in any manner that implies endorsement or affiliation without permission

• Scrape, data-mine, or use automated tools to extract content from the Site

Any feedback, suggestions, or ideas you submit to us may be used by Raw Metals without any obligation to compensate you.

9. PROHIBITED CONDUCT

By using the Site, you agree not to:

• Violate any applicable local, state, national, or international law or regulation

• Use the Site for any unlawful, fraudulent, or harmful purpose

• Transmit any viruses, malware, or other harmful code

• Attempt to gain unauthorized access to any part of the Site or its related systems

• Interfere with or disrupt the integrity or performance of the Site

• Impersonate any person or entity or misrepresent your affiliation with any person or entity

• Post or transmit unsolicited commercial communications (spam)

• Purchase products in quantities suggesting resale or commercial purposes without prior written authorization from Raw Metals

10. DISCLAIMER OF WARRANTIES

THE SITE AND ALL PRODUCTS AND SERVICES PROVIDED THROUGH IT ARE OFFERED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Raw Metals does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy or completeness of any content on the Site.

11. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RAW METALS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, PERSONAL INJURY, OR PROPERTY DAMAGE — ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT PAID BY YOU TO RAW METALS IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

12. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Raw Metals and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or in any way connected with your access to or use of the Site, your violation of these Terms, or your infringement of any third-party rights.

13. THIRD-PARTY LINKS & SERVICES

The Site may contain links to third-party websites or services — including but not limited to payment processors, social media platforms, and analytics tools — that are not owned or controlled by Raw Metals. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites. We encourage you to review the terms and privacy policies of any third-party services you use in connection with your purchase.

14. EMAIL & MARKETING COMMUNICATIONS

By creating an account or placing an order, you consent to receive transactional emails related to your purchases (order confirmations, shipping updates, receipts). These emails are necessary for the performance of your order and cannot be opted out of while your account is active.

If you subscribe to our newsletter or marketing communications, you consent to receive promotional emails about new products, restocks, and special offers. You may unsubscribe at any time by clicking "Unsubscribe" in any marketing email or by contacting us at support@raw-metals.com. Withdrawal of consent does not affect the lawfulness of any prior communications.

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding the collection, use, and protection of your personal information.

16. GOVERNING LAW & DISPUTE RESOLUTION

Governing Law

These Terms and any disputes arising from them shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles.

Informal Resolution

Before filing any formal legal claim, you agree to contact Raw Metals at legal@raw-metals.com and attempt to resolve the dispute informally. We will attempt to resolve disputes within 30 days of receiving notice.

Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Site shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place inMiami, Florida. YOU AND RAW METALS EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION.

Exceptions

Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights or unauthorized use of confidential information.

17. CLASS ACTION WAIVER

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS — WHETHER IN ARBITRATION OR IN COURT — WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT AS PART OF A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You may not bring a claim as a plaintiff or class member in any purported class action or representative proceeding.

18. CHANGES TO THESE TERMS

Raw Metals reserves the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page and may notify you by email or a prominent notice on the Site. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Site.

19. TERMINATION

Raw Metals may suspend or terminate your account and access to the Site at any time, with or without notice, for any reason — including a violation of these Terms. Upon termination, your right to use the Site will immediately cease. Sections 8 (Intellectual Property), 10 (Disclaimer), 11 (Limitation of Liability), 12 (Indemnification), and 16 (Governing Law) shall survive termination.

 

20. ENTIRE AGREEMENT & SEVERABILITY

These Terms, together with the Privacy Policy and any other policies posted on the Site, constitute the entire agreement between you and Raw Metals regarding your use of the Site and supersede all prior agreements and understandings. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
